Penalties on repeat OVI include:

Second Ohio OVI (DUI) conviction

  • Jail – ten days to six months – 20 days to six months if high BAC (.17 or above)
  • Electronic home monitoring – 18 days to 6 months
  • State OVI offense—prior OVI in 10 years and refusal of breath or chemical test results is a separate OVI charge carrying a mandatory 20 days in jail which can run consecutive to the 2/10 OVI charge carrying a minimum mandatory of 10 days in jail
  • Administrative license suspension – one year
  • Court-imposed license suspension – one to seven years
  • Fines – $525 to $1,625
  • License reinstatement fee – $475
  • Vehicle immobilization – up to 90 days
  • Mandatory alcohol assessment and treatment
  • Six points
  • Ignition interlock device if alcohol related
  • Restricted plates required

Third Ohio OVI (DUI) conviction

  • Jail – 30 days to one year and 60 days if BAC is 0.17 or above
  • Electronic home monitoring – 55 days to one year with 15 days in jail or 110 days with 30 days jail up to one year
  • Administrative license suspension – minimum two or three years
  • Court imposed license suspension – two to twelve years
  • Fines – $850 to $2,750
  • License reinstatement fee – $475
  • Vehicle immobilization – 180 days with no driving privileges and possible vehicle forfeiture if registered in driver’s name
  • Mandatory alcohol treatment program
  • Ignition interlock device required if alcohol related
  • Restricted plates required
  • Six points

Fourth Ohio OVI (DUI) conviction (within 10 years)

  • This is a felony offense
  • Jail – from 60/120 days local incarceration up to one year or 60 days in prison, w/optional 6 months to 30 months prison
  • Administrative license suspension – three or five years and no privileges for 3 years
  • Court imposed license suspension – three years to a lifetime
  • Fines – $1,350 to $10,500
  • License reinstatement fee – $475
  • Mandatory vehicle forfeiture if registered in registered in defendant’s name
  • Mandatory alcohol treatment program
  • Six points
